Does a home improvement salesperson need an MHIC license?

Short answer. Yes. Under COMAR 09.08.01.05 a home improvement salesperson must hold their own MHIC salesperson license. If yours does not, stop their sales, have them apply, and review every contract they handled.

Brenda Hayes

Your salesperson who goes door-to-door generating leads

Brenda has been selling for you for three months. You realize you never verified whether she actually has an MHIC salesperson's license. She said she did when you hired her.

You check the MHIC database. She's not in it.

  1. Correct

Under COMAR 09.08.01.05, salespersons must hold their own MHIC salesperson's license. Operating with an unlicensed salesperson makes YOU liable for their violations. Every contract Brenda signed may be legally deficient. You should have verified her license before hiring. Now: stop all sales activity, have her apply for licensing (the salesperson exam is 35 questions), and review every contract she's handled.

  2. Wrong

Every day Brenda sells without a license is another day of violations accumulating under YOUR license. If a homeowner she signed discovers she was unlicensed, the entire contract can be challenged. The MHIC will hold you responsible — COMAR 09.08.01.07 says salespersons represent the contractor. Their violations are your violations. Stop the bleeding.
