Does a building permit override HOA approval?

Short answer. No. A county permit covers building code compliance; HOA architectural approval is a separate private obligation of the homeowner. Ask HOA homeowners for approval before you start, and stop if a dispute arises.

Work it through

You're the contractor. Pick what you'd do, then see how each choice plays out.

You're building a fence for a homeowner in an HOA community. Three days in, the HOA president shows up demanding you stop work.

"This fence wasn't approved by the architectural review committee. You need to tear it down."

You have a valid building permit from the county.

  1. Correct

A county building permit and HOA architectural approval are two separate requirements. The permit covers building code compliance. The HOA covenant is a private contractual obligation of the homeowner. As the contractor, you're not party to the HOA agreement, but building work that violates it creates problems for your client. Best practice: ask homeowners in HOA communities if they've obtained architectural approval BEFORE starting work.

  2. Wrong

Building permits and HOA covenants are independent legal frameworks. A county permit does NOT override private HOA restrictions. The HOA can fine the homeowner, place a lien on the property, or require removal. Continuing work despite the HOA dispute puts your client in a worse position. Stop, let the homeowner resolve the HOA issue, then resume.
